Merck Attorneys Still Antagonizing Judge and Jury

According to an article in the Idaho Statesman (the plaintiff is from Idaho), Merck’s lawyers just can’t seem to understand that you need to get the judge, and especially the jury, to like you and your client. These defense lawyers in the New Jersey Vioxx trial didn’t learn anything from the mistakes of the defense lawyers in the Texas Vioxx trial.

The article: A key witness for the Boise man suing drugmaker Merck & Co. took the stand again Tuesday and aggressively defended his testimony that Merck knew the risks of Vioxx before it was sold.

Merck attorney Stephen Raber tried to discredit Dr. Benedict Lucchesi’s testimony, saying the heart and medication expert never saw a scientific document firsthand. The questioning caused heated exchanges, leading the judge to warn Raber twice.

Lucchesi is testifying on behalf of Frederick “Mike” Humeston, a Boise man who said taking Vioxx caused a heart attack he had in September 2001.
