Merck Gets A Day Off In Vioxx Trial

The Merck defense team was probably happy to have the Columbus Day holiday to regroup after a disastrous Friday in the Trenton, New Jersey Vioxx trial.

The trial judge instructed the jury to disregard the entire testimony of Merck’s first witness because the Merck lawyers allegedly misled the judge as to the nature of the testimony. Merck then made it’s 6th motion for a mistrial, which was denied by the judge.

Merck’s lawyers will call new witnesses beginning Tuesday. There will be no testimony on Thursday, which is the Jewish holiday Yom Kippur.
