U.S. District Judge Eldon Fallon of New Orleans has set a date of February 6, 2006, for a retrial of the first federal Vioxx trial. The original trial began Nov. 29, 2005, in Houston. The retrial will take place in the original venue of New Orleans.
It has been reported that the first jury split 8-1 in favor of Merck, the manufacturer of Vioxx.
