New Texas Law Lowers Cost of Getting Hospital Records

In what should be good news for those of us who routinely request hospital records, a new Texas law goes into effect September 1, 2009. This amendment to the Health and Safety Code will limit the fee for medical reports requested and delivered in digital format to $75 plus the actual cost of delivery. Here is the relevant portion of the act:

(3) if the requested records are provided on a digital or other electronic medium and the requesting party requests delivery in a digital or electronic medium, including electronic mail: (A) a retrieval or processing fee, which may not exceed $75; and (B) the actual cost of mailing, shipping, or otherwise delivering the provided copies.
