4 Tips for Filing a Social Security Disability Claim

When you’re injured and can no longer work, Social Security disability benefits can be a blessing. Unfortunately, the process of filing a Social Security disability claim and getting money back can be tough, especially since many people have abused the system and caused for much more thorough discrimination on the government’s behalf. If you’ve been injured and are no longer able to work, Social Security benefits may help ease the newfound financial burden and help you get on with your life. If you’re thinking of filing a disability claim, here are four tips to help get you started.

Research Disability Requirements

Just getting injured and being out of commission isn’t enough to qualify for disability benefits. The official Social Security website offers information on the disability payment requirements. Reading about these first and foremost will let you know whether or not you’re eligible and potentially spare you a lot of time. Some criteria to consider include: If you work and earn more than $1,170 per month, you are disqualified. However, investigate whether your medical condition or injury hinders you from performing basic work-related activities. Also, decide if your injury or condition prevents you from doing work at the level you previously did. Find yourself a full list of disability benefit requirements, and qualifications.

Document Your Condition

The government will want to see proof that you have been unable to work and provide for yourself since you were diagnosed. An official doctor’s diagnosis will be required as well as other medical documents that detail the extent of your injury or condition.

Collecting Unemployment

It would be harder to be awarded disability payments if you collected unemployment benefits while waiting for your case to be reviewed. You can’t apply for disability benefits unless you have been unable to or will not be able to work for at least 12 months. Although it may be difficult to make ends meet during the disability claims waiting period, most lawyers advise not collecting unemployment during this time.

Talk to a Lawyer

Speaking to a disability lawyer can help you determine whether or not you have a qualifying condition and assist you in the claim filing process, especially if you have an uncommon condition or other circumstances surrounding your case. Professionals, like Horn & Kelley, PC Attorneys at Law, know how complicated these kind of cases can be. You can always look online for lawyers, should you find yourself in need of help with your social security case.

Don’t Hesitate

You should start the disability benefits process as soon as possible. Review the requirements on the Social Security website. If you meet them, gather the proper medical documentation and prepare to file a claim. If the process is overwhelming or confusing (which it is for most), then look up a disability lawyer in your state. Many offer free consultations that will help you decide which direction to take your case.

Whatever you do, stay committed to your claim and be willing to take whatever means necessary to prove the validity of your condition and collect the benefits you need.

About This Blog

The title of this blog reflects my attitude toward those government agencies and insurance companies that routinely mistreat injured or disabled people. As a Dallas, Texas lawyer, I've spent more than 45 years trying to help those poor folk, and I have been frustrated daily by the actions of the people on the other side of their claims. (Sorry if I offended you...)
