Court Chaos: How to Protect Your Family if You are Sued

Many people never consider the possibility that they could be the target of a personal lawsuit. But the number of lawsuits in the United States alone is much higher than you may expect. And every year, the number of frivolous lawsuits costs the US economy billions of dollars. If you find yourself victim to being sued, don’t panic. Here are some things you can do to protect your family and yourself.

Assess Your Current Financial Situation

Do you have homeowners, renters, or auto insurance to protect you in the event of an unplanned lawsuit? Do you know how much you are insured for? If you get into an unintended auto accident and are found liable to pay damages, you have to check on what amount your insurance actually provides in this instance. If your auto insurance only covers up to $100,000 and you are forced to pay a sum of $200,000, in some states other than Texas you could have a lien placed on your home, have your wages garnished, or more. You and your family could lose your home and go into debt for years. What do you do?

An Umbrella Policy Could Be the Answer

An umbrella policy usually “sits” on top of your home or auto insurance. For a small amount, you will pay into the umbrella policy and it will usually help cover the extra that your existing policy does not cover. This means that if you are found liable to pay for damages, you may end up protecting your family’s home and keep yourself from going into extra, unnecessary debt well into the foreseeable future.

Speak with a Criminal Defense Lawyer

Don’t go it alone. Speaking with a good attorney is especially important if you don’t have a good comprehension of law or aren’t aware of all of your own rights. Professionals, like those at Mesenbourg & Sarratori Law Offices, know that with a good lawyer on your side, you will have the best possible chance of presenting your case in a proper manner. Also, you can rest knowing you have help in this terrifying situation. Your lawyer may even help you settle for a better deal before you even consider setting foot into the courthouse. This may protect your family from a long, drawn-out ordeal and keep you home with them where you belong.

Don’t Ignore Any Official Orders

If you have received papers ordering you to appear in court or notice that you are the subject of a lawsuit, do not ignore them. If you do, this may cause more trouble than what you are already in. If you do not appear in court, you may lose your case by reason of default.

So take a deep breath, review your options, and remember to make the choice that puts you and your family first in this difficult situation.

About This Blog

The title of this blog reflects my attitude toward those government agencies and insurance companies that routinely mistreat injured or disabled people. As a Dallas, Texas lawyer, I've spent more than 45 years trying to help those poor folk, and I have been frustrated daily by the actions of the people on the other side of their claims. (Sorry if I offended you...)
