What Should You Do When Your Workers’ Compensation Claim Is Denied?

Your bills are likely to be piling up while you may not be able to go back to work for a long time, if ever. Before you get overly upset, realize that there are things that you can do. Use these four ideas to fight after your workers’ compensation claim has been denied:

Read the Letter

You received a letter telling you that your workers’ compensation was denied. Do not wad up the letter and throw it in the trash. It tells you exactly what you need to do next in order to appeal your case. Up to 27 percent of all workers’ compensation cases were initially denied. The good news is that many of those cases were easily overturned on appeal resulting in people getting the money that they need.

Follow the Timeline

The letter contains a date by which you must file your appeal. Make sure that you keep this date firmly in mind. If you are even one day late in filing your appeal, you give up important rights. Understand that if you lose on your first appeal, then there are likely other appeals that you can make. The exact procedure varies by geographical area.

Gather Your Medical Information

You will need your medical records to make your appeal. Ask for them from any doctor that you have seen. You should also gather a statement, when possible, from any witness to your work accident. If you have previously been treated for the condition, then you will need those records too. Do not wait a long time because people move and memories fade.
